1. Acceptance of Terms

By downloading, installing, and using the Fablr app ("Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes, subject to your compliance with these Terms.

3. User Accounts

3.1 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.2 Age Requirement

You must be at least 18 years of age or the legal guardian of a minor to create an account. Parents or guardians are responsible for supervising any use of the Application by children.

4. Acceptable Use

You agree not to use the Application to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Transmit malware or harmful code
  • Attempt to gain unauthorized access to the Application
  • Reverse engineer or decompile the Application
  • Create content that is violent, sexual, or inappropriate for children
  • Impersonate other users or entities

5. Subscription and Payments

5.1 Subscription Plans

Fablr may offer subscription plans with different features and pricing. Details of your subscription plan are available in the Application.

5.2 Payment Terms

Subscriptions will renew automatically unless cancelled. Billing occurs through your app store account. You are responsible for providing accurate payment information.

5.3 Cancellation

You may cancel your subscription at any time through your app store account settings. Cancellation takes effect at the end of your current billing period.

5.4 Refunds

Refund requests are subject to the policies of the app store platform (Apple App Store, Google Play Store). We do not issue refunds directly.

6. Content and Intellectual Property

6.1 Generated Content

Stories and illustrations generated through the Application are created for personal use. You may not republish, distribute, or sell generated content without explicit permission.

6.2 User Content

By submitting family member information to generate stories, you grant us a license to use that information to create personalized stories. You retain ownership of your personal information.

6.3 Our Content

The Application, including design, functionality, and text, is owned by Fablr or our licensors and protected by copyright and other intellectual property laws.

7. Disclaimers

THE APPLICATION IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FABLR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify and hold harmless Fablr and its officers, directors, employees, and agents from any claims, damages, or costs arising from your use of the Application or violation of these Terms.

10. Modifications to Terms

We may modify these Terms at any time. Changes will be effective upon posting to the Application. Your continued use of the Application constitutes acceptance of the modified Terms.

11. Termination

We may terminate your account and access to the Application at any time for violation of these Terms or for any other reason at our discretion. Termination does not relieve you of obligations incurred prior to termination.

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action or proceeding shall be subject to the exclusive jurisdiction of the appropriate courts.
